Welcome To Oolumi,

Please read these terms and conditions carefully. If you have any questions, please ask us before confirming your booking. Do not continue to use Oolumi if you do not agree to all the terms and conditions stated on this page.

In these terms and conditions, ‘Oolumi’ means Mosnas Studios Limited whose principal place of business is Unit 8, Tilia Road, London, E5 8JB and “Client” means any person, firm or company who has been verified to rent equipment from Oolumi.

Orders 

The Client may order rental equipment or services either by email, by Instagram messenger, or verbally, by telephone or in person. Where reasonably practicable, Oolumi shall confirm orders by email.

Oolumi shall not be responsible for any errors made (by either party) in connection with verbal orders.

Oolumi reserves the right in its absolute discretion to refuse to accept any order without reason for that refusal.

The Client will notify Oolumi immediately if they require hiring any equipment beyond the contracted period. In this event Oolumi cannot guarantee any extensions on hired equipment.

Equipment collections, deliveries and returns before 8.30am or after 5.30pm must be agreed with Oolumi in advance and may incur additional fees. 

Oolumi reserves the right to cancel a rental with no refund if the Client is more than 60 minutes later than the collection time agreed over email, Whatsapp or Instagram messenger.

The equipment must be returned to Oolumi on the agreed date of the booking unless otherwise agreed with Oolumi. Late returns will incur penalty fees calculated from the published daily rate.

Items hired throughout any contract are the property of Oolumi unless stated otherwise on the produced invoice, and payment for these items has been made in full.

The Client has no interest in the equipment other than being hired to the Client for proper use. The Client will not assume ownership or act in selling, loaning, securing, mortgaging or pledging any hired equipment belonging to Oolumi..

The Client will use all equipment and ensure it is operated by experienced and qualified personnel. The Client will disclose inexperience with any equipment. The Client is not responsible for any form of consequential loss including production time. Provisions for all downtime must fall within the Client’s insurance policy.

Payment

Payment for the hire of equipment shall be made prior to the rental, or at the time of delivery or collection of the equipment by cash and/or direct bank transfer. 

In the case of default by the customer in paying any sums due, Oolumi reserves the right to withhold any equipment which are the subject of any contract with the Client and/or cancel any subsequent contract with the customer, without prior notice.

All prices advertised by Oolumi are subject to change without notice.

Deliveries & Collection

The Client may collect equipment directly from Oolumi or have it delivered or collected by Oolumi for an additional charge.

Where Oolumi has agreed to deliver equipment to the Client, equipment shall be delivered to the delivery address specified by the Client and the Client agrees to provide sufficient access to and from any relevant site. If Oolumi’S delivery team is/are unable to gain access to the delivery address and/or if delivery is delayed due to any act of the Client, the Client shall be responsible for any additional charges including waiting time as a result of rearranging delivery & parking charges.

Insurance

The Client must insure all hired equipment for the duration of the rental period (from the time the Client collects the equipment or from the time the equipment is delivered to the client and signed for) for full replacement cost and full damage repair cost unless agreed otherwise.

You shall deliver to Oolumi, prior to taking delivery of or collecting the equipment, a Certificate of Insurance in form and substance satisfactory to Oolumi, showing all risk coverage that is equal to the replacement cost of all equipment used by the production. Policies with locked vehicle warranties, unattended vehicle exclusions or any other limitations on theft from vehicles are not acceptable.

Cancellations & Refunds

Oolumi reserves the right to at its discretion charge 100% of the order value if the Client fails to provide 48 hours notice of cancellation before 00:00 of the start day of the rental. 

To be refunded for faulty equipment, the Client must notify Oolumi of any pre-existing damage to hired equipment within 2 hours of the collection or delivery of the equipment. 

Damage Or Loss To Equipment Hired

Throughout the hire period, beginning at either the time of collection or delivery of the equipment, it is the responsibility of the Client to assume all risk of loss and/or damage of the equipment. The Client shall be liable to Oolumi for all loss of or damage to the equipment howsoever caused whilst in the hirer’s possession. The Client’s responsibility includes risks while in transit, at all locations named and unnamed, at all studios, while on the Client’s own premises and while in use, or storage. 

The Client shall be liable to pay the full cost of replacement of any equipment lost or damaged beyond repair with reference to the new equipment of the same or nearest available specification.

Any loss or theft of equipment must be reported to the local police and Oolumi within 12 hours.

Oolumi reserves the right to enter any premises where equipment is believed to be held beyond the agreed hire period. Oolumi will consequently seek to recover any loss of revenue throughout this period.

Liability

Oolumi does not assume responsibility for the customer to achieve their intended result by the use of hired equipment unless Oolumi’s installation and programming services have been booked.

The Client agrees to indemnify Oolumi and to hold Oolumi and its employees and agents harmless from and against any and all third party losses, damages, claims, demand or liability of any kind or nature whatsoever, including reasonable legal expenses, related to, or arising from use, transportation, condition (including, without limitation, latent and other defects), operation of the equipment, and by whosoever used or operated during the rental term, or arising from the breach of any representation, warranty or agreement contained herein. This indemnification shall continue in full force and effect during and after the term of the rental for causes arising during the term of the rental.

If Oolumi for any reason is unable to provide any equipment which is the subject of an agreement between Oolumi and the Client then Oolumi shall not be liable for any loss or consequential loss suffered by the Hirer as a result thereof.
